Chris Langham Convicted Sex Offender - could you be next?

So Chris Langham has been found guilty of downloading child porn...its odd because in lots of ways for me, he has been  humanised by his past comedical history.

Usually I read about this sort of stuff and think to myself - dirty no good piece of shit hang him up by his bollocks and thats it, end of. Yet with thise guy its a little different. Ignoring all of his excuses as to how and why he did what he did, I couldn't help but see it all as a bit of a tragedy. An outright waste of a funny talented mans career and life over what may well have been a momentary descent into madness by a man haunted or deranged by a life once passed.

I still can't get my head around it really. He just doesn't fit the stereotype resident in my head.

I then got thinking about how anyone of us could in theory end up with similar nasty stuff on our PC's and had 'wow, fuck moment'

Did you know that web pages can contain things called iframes and that these can be set to invisible status by the people using them? IFRames are used for all sorts of things from tracking scripts to advertising scripts to general cross site inclusion of content.

Every time you visit a webpage, unless you specify otherwise in your settings,the pages and the images contained within them are downlaoded to your temporary internet files folder. If you are like me and a little lazy then these files could sit around on your puter for weeks or months.

Back to that IFRAME thing. If one of these were in a page of a site you visited, then whatever was on this invisible page would also land up on your pc. What if this page happened to contain nasty porn stuff similar to what Mr Langham had on his PC

Section 160 of the Criminal Justice Act 1988

Under the section 160 of the 1988 Act:

"(1) It is an offence for a person to have any indecent photograph or pseudo-photograph of a child in his possession.

(2) Where a person is charged with an offence under ss(1) above, it shall be a defence for him to prove -

(a) that he had a legitimate reason for having the photograph or pseudo-photograph in his possession; or

(b) that he had not himself seen the photograph or pseudo-photograph and did not know, nor had any cause to suspect, it to be indecent; or

(c) that the photograph or pseudo-photograph was sent to him without any prior request made by him or on his behalf and that he did not keep it for an unreasonable time."

This offence is a serious arrestable offence with a maximum imprisonment term not exceeding six months. It has been successfully used in its new form in the recent cases of Sharp and Crumpton.

Now IANAL but if its on your PC then aren't you in possession of it and as a result therefore, guilty?

How many ordinary users would have a clue as to what may have caused the stuff to appear on their puters?

In view of stuff like that then perhaps its a good idea to regulary delete your temporary internet files...you never know what some sick fecker might decide to hide in their pages.

Of course, you can always alter your browser settings to super high and make your browser prompt you for practically every single instance of scripted windows, or disallow iframes and java and flash and movie files and...IOW, make your internet user experiece so amazingly crap that you'll just hate it and will never want to use it again.

He paid for the image though, so he was deliberately seeking this stuff. If he had causally come across it he is very unlikely to be charged, unless he saved it in a file.

Not disputing that Steph, and I note too that most of the grounds for defence listed could well cover a circumstance in which I highlight.

I guess it also shows you that at the end of it all, ones personal computer security is something that people should take very seriously, especially if you use your PC in a public environment.

Disgruntled employees, colleagues etc, could quite easily cause a person a big big personal hassle for a what would semingly be a minimal amount of effort.

I cant think of much worse things to be accused of :(

I think in most of these cases the images aren't the one you can find accidentally visiting porn websites - so you're safe ;) Some of these images were classified as 5 on a 1-5 scale of sadism and obscenity.

You are very naughty Steph, your inference of my penchant for porn aside...the point I was trying to make which I've obviously not made very well, was that there are ways whereby people can have dodgy content slapped on their puters and be none the wiser.

Most people wouldn't have a scooby as to how it got there either, and could quite easily find themelves defending a position in front of some cynical copper thinking they were a nonce..

As for what he viewed...the man's obviously a perv out and out or a very sick individual in need of help, or maybe he's both - I don't know, I just can't identify, but then ive never been the victim of a nonce either so how can i possibly no what went on in the dark recesses of his head. Whatever he may be, he's now Chris Langham that noncey paedophile geezer who used to be a funny actor.

Yeah I know the point you were making, and there are defintely people on the sex offenders register that shouldn't be because they accepted a police caution on bad legal advice for having an indecent image of a child on the computer that they didn't know about but I don't think that's happening now. The standard advice now is not to accept the caution, and the police are more aware what to do now. Having loads of people on the sex offenders register that they don't think should be on it doesn't help them either.

It's terrible legislation. If I was writing it, I would only make it an offence if you paid or traded for the image. But do they think to ask me when they write legislation? ;)

Seems to be that legislators have a commonality of thickness.

Paid or traded would be a good start. Gifted given and accepted might need to be factored in too.

See, this is what happens when you watch too much pr0n - The lines betwen the real and the recorded end up blurred. There you were doing your thing and the liveness of the show just didn't even dawn on me...

Actually the police charge you for thumbnails they can't trace an actual image for, stuff thats downloaded through unsolicited emails and don't care a crap if you paid for it or not.

My mate had his credit card frauded and was still raided for Ore.He was able to prove it and the police actually had a piece of paper saying it had been and just lied to the magistrate to get the warrant. Its a budget thing.

He had about 16 images scattered all over his computer, none of which showed any face or identify features (and none of which he recognised) but that the DC invloved decided in "her "opinion they must be a child, he also had some thumbnails which had no images connected to them. The police use a system called ENCASE to identify images.This issues a number and the police use a catalogue. They don't even check the number is right.

My mate was cleared on all charges but it took 18months and completely broke him. its horrible and if the police just investigated this wouldn't happen.

Yes, I'm sure its the case too that if you happen to look a little noncey then they'll probably try a little bit harder to do you too. From what you say your friend seems like he falls into a category in which I describe, I dont doubt it must of been pretty shitty for him to go through that. Just wondering though, how it all came to light for him, did he get some kind of visit, did he put his pc into the menders and get reported or something?

Don't they have to have due cause or reason to suspect a person?

He was on the Ore list. He atually hadn't bought porn but some bike parts from the states. He had his details frauded and used to buy porn from several sites but only 1 was illegal. This went on over several weeks and in the end Barclaycard cancelled his card for him to stop it happening.
The police actually knew this when he was raided and in fact the part of the Ore list that they used to get the warrant actually stated "sites not visited". The DC involved simply tore that bit off the bottom and took it to the magistrates court like that and she still got a warrant. She has since been reprimanded.
He had a laptop of his own which nothing was found on. The PC involved was the family one which every man and his wife had used. In the end the defence team traced 22 different people who had used them! The DC involved knew this too and ignored it.
